SERVICE TERMS AND CONDITIONS WITH COSO TRAVEL

CONSENT TO TERMS AND CONDITIONS
The following terms & conditions describe what you can expect from us. Please read these terms before using our services and/or the website. The terms “we”, “us”, and “our” refer to CoSo Travel and the terms “you”, “your”, and “client”, refer to the individual who signs this agreement. You understand that the travel services provided by CoSo Travel are expressly conditioned upon the full satisfaction of these terms and conditions. By paying the Trip Management Fee, you hereby agree, on your behalf and on behalf of those in your travel party, to the following:

OUR RESPONSIBILITIES
CoSo Travel acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”).  We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

CLIENT RESPONSIBILITY
You assume full and complete responsibility for checking and verifying any and all passport, visa, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

You assume full and complete responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest travel supplier rules, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.

PRICINGS AND PAYMENT
Travel Management Fee: This fee, as listed on your proposal, is paid directly to CoSo Travel for the time spent researching, pricing, and providing on-site support before, during, and after travel. You agree to pay the travel management fee prior to the onset of any  services. All of our fees are non-refundable. While we do our best to maintain the pricing listed on your proposal, we reserve the right to increase costs.

Supplier Payments: You understand and agree that the travel management fee does not cover the cost of travel arrangements from Suppliers. For such costs, payment is due prior to departure according to each Supplier’s terms and conditions involved in your travel booking. You agree to be financially responsible for all Supplier arrangements. If payments are not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. You are responsible for providing us with a signed authorization form that gives us the authority to purchase on your behalf and charge it to your credit card or another authorized payment method. 

Supplier price quotes are applicable to the date and time at which they are issued and cannot be guaranteed until payment is made. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card issuer fees. We are not responsible for any increases due to fuel surcharges, government-imposed taxes/fees, or supplier-imposed increases.

CREDIT CARD MERCHANT
We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

CANCELLATION
All cancellation requests must be sent to CoSo Travel in writing. Our Travel Management Fees are non-refundable.  Suppliers have their own contracts covering cancellation penalties and other terms and conditions. Cancellation penalties are advised at time of booking and provided to you upon confirmation. You agree to review and agree to all the terms, conditions and penalties of the suppliers. If you have any questions, or any penalties are unclear, please contact us.

INSURANCE
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

PROHIBITED RESERVATIONS 
You agree to make only legitimate travel reservations with and through ys. You agree not to make or attempt to make any reservation with intent to cancel after benefitting from a promotion, any speculative, false, or fraudulent reservation or any reservation in anticipation of benefiting from demand, without intent to use the reserved travel. 

RISKS OF TRAVEL AND RELEASE
We assume no responsibility for and shall not be liable for the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on “Find International travel Information” then click on “Country Information”, and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. 

You hereby expressly assume all of these risks and dangers, and you hereby expressly agree to forever release, discharge and hold us, and our agents, employees, associates, affiliated companies, guides, group leaders, suppliers, and subcontractors harmless against any liability, actions, causes of actions, suits, claims, and demands of any and every kind and nature whatsoever which you have or which may hereafter arise out of or in connection with these risks and dangers. 

PRIVACY POLICY

This Privacy Policy applies to information we collect about you when you use our website, any mobile app that we offer, and social media that we participate in. 

What Personal Information Do We Collect?
We collect your personal information (and that of your travel companions) that is provided to us either directly by you or your travel companion, as applicable, in order to provide you with the products and services you have requested. We may also collect your travel companion’s personal information. Personal information can consist of your full legal name, address, email address, phone numbers, and credit card information, passport number, driver’s license or other government-issued identification number, date of birth, gender, arrival and departure locations and times, airline, hotel or car rental frequent loyalty numbers, seat preferences, known traveler and global entry number, and other related travel information.

Information We May Collect Through Automatic Data Collection Technologies
We may collect other information, such as your IP address, search terms, and site pages when you visit us online. The technologies we use for this automatic data collection may include cookies and log data. We may use Google Analytics, which collects the cookie data. Go to https://policies.google.com/technologies/partner-sites for an explanation of how it collects and uses data. By using our website, you consent to our use of cookies.

We may also use IP addresses to identify a visitor when we feel it is necessary to enforce compliance with our website’s Terms and Conditions, or to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our website, or other users.

How Do We Use Preference Based Advertising, Analytics, and Services?
We do not currently share your information that we collect for preference-based advertising purposes and we do not currently have any plans to do so.

Who Do We Share Your Information with and Why?
Travel Suppliers: We share your personal information as necessary with airlines, cruise lines, hotels, car rental companies, and other providers for whose services you have requested our assistance. We enter this information in the Global Distribution System (GDS), which passes it on to the travel suppliers. 

Transfer of Assets: We do not sell or lease personal information or provide a list of our customers to third parties. However, if another entity acquires us or all (or substantially all) of our assets, the information we have about you will be transferred to and used by this acquiring entity. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Other Sharing: We may also share your information to protect and defend our rights and property.

Your California Privacy Rights
List of Third Parties: If you are a resident of the State of California, you may obtain a list of all third parties to which we have disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes, if any. You may request the information in writing at hello@cosotravel.com.

Corrections: If you wish to make corrections to any personal information you have provided, contact us at hello@cosotravel.com.

Do Not Track Disclosures: We do not take any particular action based on browser based Do Not Track (DNT) Notices; nor do we track your use of other websites.

Changes to This Policy: We may from time to time make changes to this Privacy Policy to reflect changes in legal or regulatory obligations or changes in the manner in which we deal with personal information. We will post any revised version of this Privacy Policy on our website. Any changes will be effective on the effective date stated in the revised Privacy Policy. If there are significant changes, we may provide more prominent notice or obtain your consent, if required by law.
